‘North Dakota House Gives Fertilized Eggs Human Status’ reads the title of a story in foxnews.com dated 18 February 2009

A measure approved by the North Dakota House gives a fertilized human egg the legal rights of a human being, a step that would essentially ban abortion in the state. . .

The bill declares that “any organism with the genome of homo sapiens” is a person protected by rights granted by the North Dakota Constitution and state laws.

Way to go.

  1. That is an encouraging development. I will be surprised, however, if is will hold up. This will likely be hotly contested and eventually overturned at the Supreme Court level, well, unless God changes the soul of our nation.

  2. From reading the news item to which you linked it seems that this proposal is not yet law as it has not been reviewed by the ND Senate.

    Indeed it seems quite impractical. For example, would it still be legal to prescribe or take the pill (which is an abortifacient after all)? What if it were prescribed for other than contraceptive reasons (which is not uncommon here in NZ) would that be legal? How would you prevent its being used for contraceptive purposes?

    This seems like a proposition which is doomed (perhaps even designed) to fail through being unenforceable. Looks more like grandstanding than good sense to me (and before you label me N, I am not in favour of abortion).
